This Privacy Policy provides you with information about the types of information we collect about you and your use of Vivacare, how the information is used and how it is safeguarded.

This Privacy Policy applies to websites owned and operated by Vivacare, including but not limited to Vivacare.com (referred to herein as “Vivacare Websites” or “Vivacare Services”). This policy also applies to mobile optimized versions of these sites, as well as the Vivacare mobile application (“App”).

Vivacare may share information among the websites and apps that it owns or controls, but information collected under this Privacy Policy is always protected under the terms of this Privacy Policy.

This Privacy Policy applies to individuals (“Individual Users”) who view content on Vivacare Websites or apps. If you are a “Professional User”, please refer to our Privacy Policy – Professional Users.

Information We Collect About You

Personal Information

You will be required to submit Personal Information if you choose to register and make use of the Vivacare mobile application or access certain functionality on Vivacare Websites. Different types of Personal Information are requested by Vivacare depending on the type of content or service requested by the User.

“Personal Information” means information that we can use to identify or contact you. As an Individual User of the Vivacare Service, you will provide us with the registration information listed below.

You are responsible for ensuring the accuracy of the Personal Information you submit to Vivacare. Inaccurate information will affect your experience when accessing Vivacare Services or the Vivacare App, and our ability to contact you.

Registration Information

Access to Vivacare’s mobile App is limited to users who register by entering Personal Information that enables the App to function, such as the identity of the medical professional or health organization from which they wish to receive content. Information collected during registration for Vivacare Services includes:

  • Email address (required)
  • Password (required)
  • Identity of your medical professional or his/her practice (optional)
  • Clinical topics of interest to you (optional)

Vivacare stores your Personal Information in accordance with this Privacy Policy and the authorization you provide when you submit your Registration Information.

The information you provide during registration enables Vivacare to send you personalized emails and/or secure electronic in-app messages and better tailor the content or service to meet your needs.

Communications to You

At various times during your use of the Vivacare Services or Apps we may communicate with you via email or in-app notifications.

By default, you will be opted in to receive newsletters from Vivacare. You may choose to opt out of receiving additional newsletters at any time by following the unsubscribe directions at the bottom of each email message.

Additional Information Collected

Due to internet transmission standards, when you visit the Vivacare website or mobile App certain information is recorded. This information includes the URL of the site from which you came to Vivacare and the URL of the site you went to when you left Vivacare. Your computer’s operating system and type of web browser and your ISP or mobile carrier are also recorded. We use this information to analyze trends and help improve our services.

Like most websites, Vivacare uses cookies and web log files to track site usage. A cookie is a tiny data file that resides on your computer and allows Vivacare to recognize you as a user when you return to Vivacare from the same computer and browser. Cookies (if enabled on your computer) allow you to return to Vivacare without logging in again.

Vivacare may work with third parties to display content on some of the Vivacare Websites. These third parties may use their own Cookies or other online tracking technologies to monitor the usage of their content. These technologies are not used to display advertising.

Your Right to Access or Correct Information about You

You can correct, update or review Personal Information you have previously submitted by going back to the specific tool or application, logging-in and making the desired change.

The Vivacare Services cannot provide value to you without using the personal information you entered during registration. If you chose not to share this information with Vivacare, you may delete your account and discontinue using the Services.

Uses of Personal Information

Vivacare is a service designed to help medical professionals provide valuable information to their patients. The information about you that you choose to provide us helps us provide relevant, current information to you on behalf of your physician or other medical professional.

Other ways we use your personal information:

  • To administer your account
  • To provide you with access to particular tools and services
  • To respond to any inquiries you send to us
  • To obtain your feedback about Vivacare Services

Vivacare may combine Personal and Non-Personal Information collected by Vivacare about you, and may combine this information with information from external sources.

We use Cookies in order to determine whether you have seen certain content so that we may request your opinions or provide related content. We may also use Cookies to authenticate respondents or to help you pick up where you left off in a survey.

Sharing Information with Third Parties

Except as described in this Privacy Policy or as specifically agreed to by you, Vivacare will not disclose any Personal Information it gathers from you through Vivacare Websites or Apps. We release Personal Information to third parties only to: (1) to comply with legal requirements such as a law, regulation, search warrant, subpoena or court order; or (2) in special cases, such as in response to a physical threat to you or others, to protect property or defend or assert legal rights.

In the event of a corporate change in control resulting from, for example, a sale to or merger with another entity, or in the event of a sale of assets or a bankruptcy, Vivacare reserves the right to transfer your Personal Information to the new party in control or the party acquiring assets. In the event of such a change, your Personal Information will continue to be treated in accordance with this Privacy Policy, which may be modified from time to time.

The Vivacare Customer Support team has limited access to your Personal and Non-Personal Information as needed in the course of providing products or services to you.

Disclosures to Third Party Web Sites

Vivacare does not sell, rent or otherwise provide your personal information to third parties for marketing or other services.

Certain content and services offered to you through Vivacare Websites are served on, or contain links to, web sites hosted and operated by companies other than Vivacare (“Third Party Web Sites”). Vivacare does not disclose your Personal Information to these Third Party Web Sites, but you should be aware that any information you disclose to the other websites is not subject to the Privacy Policy of that website, not this Privacy Policy.

Securing your Information

We use industry standard security measures to protect your Personal Information. However, despite Vivacare’s efforts to protect your Personal Information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet may be intercepted.

The security of your Personal Information is important to us. We encrypt all Personal Information during transmission and when stored in our database. All Vivacare employee access to your data is on a “need to know” basis. We host all our data at Rackspace, an industry leading, secure cloud hosting provider. Rackspace infrastructure and facilities are regularly audited, and have achieved numerous certifications, including: ISO 27001/27002; PCI-DSS Level 1; SSAE16 SOC1, SOC2 and SOC3; Safe Harbor, and CPS.

You may remove your Personal Information or instruct us to remove it at any time, but you should be aware that residual information about you will remain in our backups for a period of time. We will also retain your Personal Information as necessary to comply with legal obligations, resolve disputes and enforce our agreements. All Personal Information about you that we retain for any reason will be stored using the same strict security practices described above.

Vivacare Services are available to all U.S. residents over the age of 18.
